1. Acceptance of Terms

By accessing or using the Mindfuse mobile application ("the App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Use of the App

1. Eligibility: You must be at least 18 years old to use the App. You register with your phone number and provide your age. All AIs, bots, or automated systems are excluded from using our services.

2. Lawful Use: You agree to use the App only for lawful purposes and in accordance with all applicable laws and regulations.

3. Account Responsibility: You are responsible for any activity that occurs under your account and must keep your login credentials confidential.

3. Privacy

1. Privacy Policy: Your use of the App is also governed by our Privacy Policy, which is available on the profile page of the App. Please review the Privacy Policy to understand how we collect, use, and disclose your information.

4. Content and Intellectual Property

1. Ownership: All content, features, and functionality within the App, including but not limited to text, graphics, logos, images, audio, and video, are the property of Mindfuse and are protected by copyright, trademark, and other intellectual property laws.

2. Restrictions: You may not reproduce, distribute, modify, or create derivative works from any content within the App without prior written consent from Mindfuse.

5. Termination

1. Right to Terminate: Mindfuse may terminate or suspend your access to the App without notice for any reason, including a violation of these Terms.

2. Consent Withdrawal: Your use of the App constitutes consent to the collection and use of your name and phone number as outlined. You may withdraw your consent and request deletion of your data at any time. If you want to delete your phone number from our database, delete it in the Mindfuse app by clicking delete subscription.

6. Disclaimers

1. "As-Is" Basis: The App is provided on an "as-is" and "as-available" basis, and Mindfuse makes no warranties or representations regarding the accuracy, completeness, or reliability of the content or the availability of the App.

7. Limitation of Liability

1. No Liability: Mindfuse and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Governing Law

1. Jurisdiction: These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.

10. Changes to Terms

1. Updates: Mindfuse reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting, and your continued use of the App after such changes constitutes your acceptance of the revised Terms. Changes will be communicated 30 days before they take effect.

11. Subscription Options

1. Monthly Subscription: Users opting for the monthly subscription will be billed on a recurring monthly basis until the subscription is canceled. The subscription fee will be charged to the user's selected payment method at the beginning of each billing cycle. The subscription costs €24.99 per month, available exclusively on iOS. This subscription grants you unlimited access to all features and can be canceled at any time.

12. Why Subscription?

1. Subscribing to our App grants users exclusive access to the Mindfuse's core functionality. This feature gives you the ability to fuse all over the world whenever you want to.

13. Subscription Cancellation

1. For iOS Users (App Store): Users who have subscribed to our App's services via in-app purchases on iOS devices can cancel their subscriptions by following these steps:

  • Open the Settings app on their device.
  • Tap on their name at the top of the Settings menu.
  • Select "Subscriptions."
  • Find the subscription associated with our App and tap on it.
  • Tap "Cancel Subscription" and follow the prompts to confirm the cancellation.

2. Cancellation Notice: Cancellation requests must be made at least 24 hours before the next billing cycle to avoid being charged for the subsequent period. Upon cancellation, users will retain access to the subscribed features until the end of the current billing cycle.

14. Reporting Violating Behavior

1. Community Safety: We rely on the community to keep the environment safe and healthy. If you encounter inappropriate behavior, you can report it via the reporting feature in our application. Consistent inappropriate behavior may lead to permanent removal from the platform.

15. Zero Tolerance for Objectionable Content and Abusive Behavior

1. Policy on Objectionable Content: There is zero tolerance for objectionable content or abusive users on Mindfuse. This includes hate speech, harassment, explicit content, or any form of abuse. Violations will result in warnings, suspensions, or permanent bans based on severity and frequency.

2. Filtering Objectionable Content: We use a combination of automated tools and human moderators to filter objectionable content.

3. Users have the ability to block other users who are abusive or engaging in objectionable behavior through the app's interface.

4. Acting on Reports: Mindfuse commits to acting on reports of objectionable content within 24 hours. We will remove the content and eject the user who provided the offending content if necessary.

16. License to Use Our Services

1. License Grant: By registering with Mindfuse, you receive a personal, non-transferable license to use our services. This license ends once you stop using our services or when your account is terminated.

17. Limitation of Liability

1. Limitation: By using our services, you agree that Mindfuse's liability is limited to the maximum permitted under the law.

18. General

1. Updates: Mindfuse may update the User Agreement at any time. Changes will be communicated 30 days before they take effect. By continuing to use our services after that date, you agree to the amended terms.
